The United States has proposed a new rule prohibiting the employers from filing multiple applications for H-1B visa, widely sought by Indians, in a fiscal year, amid a growing clamour to raise the cap to allow more skilled professionals from India and other countries to work in the US.

“To ensure a fair and orderly distribution of available H-1B visas, USCIS will deny or revoke multiple petitions filed by an employer for the same H-1B worker and will not refund the filing fees submitted with multiple or duplicative petitions,” the US Citizenship and Immigration Services said in an announcement.

The USCIS has sent the interim final rule for publication in the Federal Register to make it effective.

These changes will ensure that companies filing H-1B petitions subject to congressionally mandated numerical limits have an equal chance to employ an H-1B worker.

This rule does not preclude related employers (such as a parent company and its subsidiary) from filing petitions on behalf of the same alien for different positions, based on a legitimate business need.

The USCIS has said that in last August, President George W Bush announced that the Administration would be undertaking a series of immigration and border security reforms and changes to the H-1B filing process under this rule are an important part of that initiative.

According to the agency from April 1, 2008, employers can file petitions requesting H-1B workers for fiscal year 2009 employment starting on October 1, 2008.

The Congress has set a limit of 65,000 for most H-1B workers for the fiscal 2009.

Additionally, the first 20,000 H-1B workers who have a US Master’s degree or higher are exempted from the cap.

Under current procedures, which are not changed by this rule, once USCIS receives 20,000 petitions for aliens with a US Master’s degree or higher, all other cases requesting the educational exemption are counted toward the 65,000 cap.

Once the 65,000 cap is reached for a fiscal year, USCIS will announce that the cap has been filled and reject further petitions subject to the cap.

The rule also stipulates that if USCIS determines the number of H-1B petitions received meets the cap within the first five business days of accepting applications for the coming fiscal year, USCIS will apply a random selection process among all H-1B petitions received during this time period.

“If the 20,000 advanced degree limit is reached during the first five business days, USCIS will randomly select from those petitions ahead of conducting the random selection for the 65,000 limit. Petitions subject to the 20,000 limit that are not selected in that random selection will be considered with the other H-1B petitions in the random selection for the 65,000 limit,”.

The rule further clarifies that USCIS will deny petitions that incorrectly claim an exemption from any H-1B numerical limits and those filing fees will not be returned.

“Microsoft has found that for every H-1B hire we make, we add on average four additional employees to support them in various capacities,” Gates, who once said that if he had his way he would scrap the H-1B visa system entirely, told a House of Representatives Panel on Science and Technology.

By maximizing the spectroscopic capabilities of NASA’s Spitzer Space Telescope and high-resolution measurements from the Keck II Telescope in Hawaii have found water vapor in protoplanetary disks of dust and gas around two young stars, which might bring scientists one step closer to understanding water’s role during terrestrial planet formation.

Water is an essential ingredient for forming planets, yet has remained hidden from scientists searching for it in protoplanetary systems, the spinning disks of particles surrounding newly formed stars where planets are born.

Now, researchers from the California Institute of Technology and other institutes found water molecules in disks of dust and gas around two young stars known as DR Tau and AS 205A, which are respectively around 457 and 391 light-years away from Earth.

These stars are each at the center of a spinning disk of particles that may eventually coalesce to form planets.

“This is one of the very few times that water vapor has been detected in the inner part of a protoplanetary disk - the most likely place for terrestrial planets to form,”.

Scientists first harnessed light-emission data captured by Spitzer to inspect dozens of young stars with protoplanetary disks.

They honed in on DR Tau and AS 205A because these presented a large number of water emission lines - spikes of brightness at certain wavelengths that are a unique fingerprint for water vapor.

“Only Spitzer is capable of observing these particular lines in a large number of disks because it operates above Earth’s obscuring water-vapor-rich atmosphere,”.

To determine in what part of the disk the vapor resides, the team made high-resolution measurements at shorter wavelengths with NIRSPEC (Near-InfraRed cross-dispersed echelle grating Spectrometer) for the Keck II Telescope.

NIRSPEC can resolve individual water lines in selected regions where the atmospheric transmission is good. The shape of each line relays information on the velocity of the molecules emitting the light.

“They were moving at fast speeds, indicating that they came from close to the stars, which is where Earthlike planets might be forming,”.

“While we don’t detect nearly as much water as exists in the oceans on Earth, we see only a very small part of the disk - essentially only its surface - so the implication is that the water is quite abundant.”

“Although they have not detected icy solids in the extrasolar disks, our observations are possible evidence for the migration of solids in the disk. This is an important prediction of planet-forming models,”.

The presence of water in the inner disk may indicate its stage on the road to planet formation. A planet like Jupiter in our solar system grew as its gravitational field trapped icy solids spinning in the outer part of the sun’s planetary disk. However, before Jupiter gained much mass, these same icy solids could have traveled towards the star and evaporated to produce water vapor such as that seen around DR Tau and AS 205A.

Although they have not detected icy solids in the extrasolar disks,“the observations are possible evidence for the migration of solids in the disk. This is an important prediction of planet-forming models.”

These initial observations portend more to come,. “We were surprised at how easy it is to find water in planet-forming disks once we had learned where to look. It will take years of work to understand the details of what we see.” says scientists.

Introduction

The Board of Control for Cricket in India (BCCI) launched the Indian Premier League (IPL) on September 14, 2007. Based on the lines of the English Premier League (EPL) and the National Basketball League (NBA), the IPL is said to be the brainchild of BCCI vice-president Lalit Modi. The idea was first floated in 1996 but was shot down as the board felt it would go against the zonal system of domestic cricket. The project moved into top gear when the Zee group launched a rival Indian Cricket League on similar lines in April 2007.

Indian Premier League

The Indian Premier League, created by the Board of Control for Cricket in India (BCCI) and sanctioned by the International Cricket Council, is a Twenty20 cricket competition. The Indian Premier League starts on April 18th, 2008 - June 1st, 2008. The overall prize money will be US $5 million, with the winners taking home $2 million. The remaining will be up for grabs in different forms, like man of the match awards and cash prizes. By contrast, the winners of the 2007 ICC World Cup in the Caribbean took home $1 million; the Indian team that won the World Twenty20 got half of that. TV rights have already gone for over $1 billion. Franchisees have already committed close to US $723 million. Top players are expected to earn minimum 1-2 crores per season.

BCCI has formed an IPL council that comprises former BCCI president IS Bindra, vice-presidents Rajiv Shukla, Chirayu Amin, Lalit Modi and Arun Jaitley, and former cricketers Mansur Ali Khan Pataudi, Sunil Gavaskar and Ravi Shastri. While the BCCI officials are honorary members, Pataudi, Gavaskar and Shastri will be paid for their services. The IPL governing council will have a five-year term and will run, operate and manage the league independently of the BCCI. The franchisees will own the eight teams in the fray. They can run them in their own styles, bring their own sponsors and even name the team according to their choice. They will even be free to list their teams on the stock exchange.

Television Rights

On January 14th, 2008, it was announced that a consortium consisting of India’s Sony Television network and Singapore-based World Sport Group secured the rights of the Indian Premier League.The record deal has a duration of ten years at a cost of US$1,026 million. As part of the deal, the consortium will pay the BCCI US$918 million for the telecast rights and US$108 million for the promotion of the tournament.

The BCCI announced that the bulk of the proceeds from this deal would initially go to the IPL franchises themselves, gradually reducing this amount over the life of the contract. Network Ten has bought the rights to show every game live in Australia on free-to-air television for the next five years at a cost of AU$10 - $15 million. Setanta Sports have secured the UK rights in a 5-year deal. All 59 games will be shown on their subscription channels.
